Britney Spears’s ex Kevin Federline gets increased custody of sons, files restraining order against Jamie Spears
Britney Spears’s new custody agreement scales back the amount of time she gets with her two sons — and that’s just part of the Spears family drama.
While the pair had been splitting 50-50 custody, her ex, Kevin Federline, now gets 70 percent custody of Sean Preston, 13, and Jayden James, 12, while the pop performer gets 30 percent unsupervised custodial rights, according to court documents obtained by E! News and TMZ.
The agreement was put in place in August 2018, according to both outlets. However, it became “official and formalized” on Aug. 28.
Federline’s attorney, Mark Vincent Kaplan, later told People magazine that they moved to make the agreement official after an incident that occurred while Spears had the children. Federline filed a police report against Spears’s father, Jamie Spears, on Aug. 25, alleging battery on Sean Preston. The trouble reportedly took place a day earlier when Sean Preston allegedly was behind a locked bedroom door and Jamie broke down the door to get in and then "violently shook" the child, The Blast reports. Spears then got both sons away from her father — and Federline was called to pick them up.
Federline’s lawyer told People, “There was a disagreement that occurred while Britney and the children were visiting with Jamie at his home that led to a physical altercation. Britney did the right thing and removed the children and took them out of there, but the trauma to the kids is nonetheless.” Jamie didn’t comment.
Kaplan told People late Tuesday that Federline considered getting protective order against Jamie when he went to the police station, but they decided to try to work it out instead. However, The Blast reported on Tuesday night that Kevin had filed a restraining order against Jamie in the couple’s ongoing custody case — and it has been granted.
While the Ventura County District Attorney's Office looks into the case, Kaplan filed the documents to officially change the couple’s custody agreement to 70/30. The attorney added that Federline actually has the boys “closer to 90” percent of the time while Spears has them for 10 percent of the time. ‘
Kaplan also said that Spears’s time with the boys is supervised.
It’s well-documented that Spears has had ongoing mental health problems. Earlier this year, she completed a 30-day stay at a mental health facility. She’s been candid about battling anxiety and had a very public mental breakdown in 2007 when she initially separated from Federline and, for a time, lost custody of their children altogether.
Spears has had a conservatorship in place with Jamie in charge since 2008. Amid her most recently problems, there was a question over whether Spears was forced to enter treatment against her will. Her mother, Lynne Spears, who is divorced from Jamie, moved to become more involved in conservatorship matters. She hadn’t previously been involved with the conservatorship at all.
Spears, who hasn’t spoken publicly about losing time with her boys or the incident between her father and Sean Preston, loves sharing their adventures on social media. In early August, the trio visited Disneyland.

Their posh lifestyle with their famous mom factored into Federline seeking the court’s help in renegotiating their custody agreement last year. K-Fed sought increased child support payments because Spears was making more money and he was making less than when they first came to terms in 2007. He also now has them more of the time.
In court documents, Federline’s legal team noted that when the children were with Spears, they had private chefs and tutors as well as "toys" including ATVs, video game systems, iPads and laptops. It also noted that Spears takes them on multiple vacations a year at luxury resorts. However, Federline — who was receiving about $20,000 a month in child support — couldn’t afford to take them on vacation. He said he didn’t have space in his house for his sons to have sleepovers.
In August 2018, a lawyer made Spears pay Federline more than $100,000 for support and his legal fees. Soon after, they reportedly renegotiated the support, increasing Federline’s payments to “thousands more” a month.
Federline has six children in total — including two with his wife, Victoria Prince, and two with ex Shar Jackson.
Spears, who has been in a relationship with model and actor Sam Asghari for the last two years, had her fans worried with her cryptic Instagram messages amid her mental health woes. Some blamed her father Jamie’s tight grip on Spears for some of her problems.
That said, a Spears source told People magazine last month, “Earlier this year was a scary time for her, but she is doing really well now. Britney is having a great summer. Sam has been around a lot — he really takes care of Britney.” And she was “spending more time with” her sons because she feeling “healthier.”
